Terms of sale

Terms for subscribing to and using Habily plans.

Last updated: 4 November 2026

This document is under legal review. Items in brackets will be completed before final publication. The French version prevails.

1. Purpose

These terms of sale govern the online subscription to and use of the Habily software, published by [Raison sociale] (“Habily”), by any real estate professional (“the Customer”). They prevail over any other document unless otherwise agreed in writing.

Habily is an online service for professionals. By subscribing, the Customer confirms acting in the course of its business.

2. Subscription

Subscription takes place on habily.net: the Customer picks a plan and a billing period (monthly or yearly), enters its agency and administrator details, accepts these terms and pays.

The contract is formed when the payment is confirmed. The agency workspace is then created and a link to set the administrator's password is sent by email. No workspace is created without payment; an unpaid sign-up expires automatically.

3. Prices and payment

Plan prices are shown in CFA francs on the Pricing page at the time of subscription. The price of the chosen plan and period is locked for the paid period and its renewals, unless the plan changes.

Payment is immediate and online through our payment provider Bictorys (Wave, Orange Money or bank card). Habily never has access to your full card details. An invoice is provided for each payment.

Promo codes: a discount may apply under the code's conditions (eligible plans and periods, duration, number of uses). It is checked and calculated before payment, then kept for the renewals covered by the code.

4. Term and renewal

The subscription runs for the paid period (one month or one year). There is no automatic debit: before the period ends, the Customer receives reminders (in-app, email) with a payment link and renews if it wishes.

Without renewal, the workspace remains available for a grace period, then switches to read-only. Data is not deleted at this stage; a payment restores full access.

5. Use of the service

The Customer is responsible for its users' accounts, the confidentiality of their credentials and the use made of the service. It undertakes to use Habily in compliance with applicable laws, including on leases, co-ownership, tax, data protection and communications (WhatsApp, email).

Values that depend on law or practice (deposit, advance, fees, penalties, voting rules…) are entered and configured by the Customer, under its responsibility.

6. Customer data

The Customer remains the owner of the data it enters. For the personal data of its own clients (tenants, landlords, co-owners…), the Customer is the controller and Habily acts as processor, on its instructions, as described in the privacy policy.

At the end of the contract, the Customer may request an export of its data for [export period, e.g. 30 days]. After that period, data is deleted, subject to legal retention obligations.

7. Availability and support

Habily uses reasonable means to keep the service available, except for maintenance and events beyond its control. Support is provided via WhatsApp and email during the hours shown on the Contact page.

8. Liability

Habily has an obligation of means. Its liability may only arise from proven fault and is limited, for all damages combined, to the amounts paid by the Customer over the last twelve months. Habily is not liable for indirect damages or for decisions made by the Customer based on information from the service.

9. Termination

The Customer may stop using the service at any time by not renewing; the current, already paid period is not refunded unless otherwise provided. Habily may suspend or terminate access in case of serious breach by the Customer, after a formal notice left unanswered for fifteen days, except in emergencies.

10. Changes to these terms

Habily may amend these terms. The applicable version is the one accepted at subscription or at the latest renewal; the Customer is informed of any change before it applies.

11. Governing law and disputes

These terms are governed by Senegalese law and the OHADA uniform acts. Failing an amicable settlement, any dispute falls under the jurisdiction of the [Tribunal de commerce hors classe de Dakar — à confirmer].
